1. Agreement to Terms

By accessing and using Active Recreation Canada's services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Active Recreation Canada, concerning your access to and use of our outdoor adventure services, website, and related applications.

If you disagree with all or part of these terms of service, then you are expressly prohibited from using our services and you must discontinue use immediately. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Adventure Services and Activities

Active Recreation Canada provides outdoor recreational activities including but not limited to skiing, snowboarding, mountain biking, whitewater rafting, hiking, and wilderness expeditions. All activities are inherently risky and participants acknowledge that they engage in these activities at their own risk.

Participants must meet minimum age requirements, physical fitness standards, and skill levels as specified for each activity. We reserve the right to refuse service or remove participants who do not meet safety requirements or whose behavior endangers themselves or others.

3. Booking and Payment Terms

Reservations

  • All bookings must be made through our official website or authorized booking agents
  • Full payment is required at the time of booking unless otherwise specified
  • Reservations are subject to availability and weather conditions
  • Group bookings may require special arrangements and deposits

Cancellation Policy

  • More than 7 days: Full refund minus 10% processing fee
  • 3-7 days: 50% refund
  • Less than 3 days: No refund unless due to weather or safety conditions
  • Weather cancellations: Full refund or rescheduling option

4. Safety Requirements and Liability

Participant Responsibilities

All participants must complete and sign liability waivers before engaging in any activities. Participants are required to disclose any medical conditions, medications, or physical limitations that may affect their ability to safely participate in activities.

Safety Equipment and Guidelines

  • All safety equipment must be worn as directed by guides
  • Participants must follow all safety instructions and guidelines
  • Alcohol and drug use is strictly prohibited during activities
  • Participants who fail to comply with safety requirements will be removed from activities

Limitation of Liability

Active Recreation Canada, its employees, guides, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from participation in activities, except as required by law. Maximum liability is limited to the amount paid for services.

5. Equipment and Property

We provide high-quality safety and recreational equipment for all activities. Participants are responsible for the proper use and care of all equipment provided. Damage to equipment due to misuse or negligence will result in replacement charges.

Participants may bring personal equipment subject to our safety inspection and approval. We are not responsible for damage or loss of personal equipment during activities.

6. Photography and Media Release

By participating in our activities, you grant Active Recreation Canada the right to use photographs, videos, and other media taken during activities for marketing, promotional, and educational purposes. If you do not wish to be photographed or filmed, please notify your guide at the beginning of the activity.

7. Environmental Responsibility

All participants must follow Leave No Trace principles and respect wildlife, vegetation, and natural resources. Littering, vandalism, or any behavior that damages the environment is strictly prohibited and may result in removal from activities and legal action.

We are committed to sustainable tourism practices and expect all participants to share in this responsibility to preserve Canada's natural wilderness for future generations.

8. Weather and Natural Conditions

Outdoor activities are subject to weather and natural conditions beyond our control. Activities may be modified, postponed, or cancelled for safety reasons. In case of weather-related cancellations, participants will receive full refunds or the option to reschedule.

We monitor weather conditions closely and make decisions based on safety considerations. Final decisions regarding activity continuation rest with our certified guides and management.

9. Privacy and Data Protection

Your privacy is important to us. Personal information collected during booking and participation is used solely for service delivery, safety purposes, and communication. We do not sell or share personal information with third parties except as required by law.

10. Intellectual Property Rights

All content on our website, including text, graphics, logos, images, and software, is the property of Active Recreation Canada and is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution of our content is prohibited.

11. Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration under the laws of British Columbia, Canada.

These terms are governed by Canadian federal law and the laws of British Columbia. Any legal actions must be brought in the appropriate courts of British Columbia.
